Utility Merger News

As previously reported, on May 5, 2017 Great Plains Energy (GPE), Kansas City Power & Light, and Westar Energy filed a petition for reconsideration (PFR) of the Kansas Corporation Commission’s (KCC’s) order rejecting GPE’s proposed acquisition of Westar.  Today the KCC denied this petition finding that it “does not meet the legal requirements for a petition for reconsideration” and, accordingly, the docket is closed.

Of note, the KCC explicitly encouraged “the parties to continue working together to ‘revise the Transaction to address the Commission’s concerns related to purchase price, capital structure and other issues’ and welcomes the filing of a new application that can satisfy the merger standards and advance the public interest.”  See KCC Order in Docket No. 16-KCPE-593-ACQ at 3.
