We assisted a utility with the design, administration and evaluation of its power supply procurement processes. Specifically, we developed and administered the request for proposals (“RFP”), managed the due diligence process for interested parties, supported the development of transaction terms and documents, provided a preliminary review and modeling of bids received, identified the short list of bidders whose bids were then evaluated, supported negotiations and the development of final transaction documents, and provided regulatory support, including expert testimony. The RFP solicited proposals for power purchase agreements, asset acquisitions and development opportunities. The RFP specified that proposals would be evaluated in comparison to a potential self-built natural gas fired plant.
